Original artist, are you kidding or what? Some dude grabs a pic of the Royal family and a pic of Moz and photoshops them together and that's art that they supposedly own? Come off it CG. The original (cough, splutter) artist does not have a photoshopped leg to stand on. Just because you make a collage and post it on the net, it doesn't make it copyrighted. If he was so precious about it he never would've posted it in the first place.

This is the key word. The original artist made the collage IN THE SPIRIT OF ART. Morrissey's team cribbed the art IN THE SPIRIT OF MAKING MONEY. A judge would side for the artist in a hot second, you might as well cut him a check today.

That's great that you're married to a lawyer. It sounds like you're the one who may need the legal advice before you sign up to help someone who stole copyrighted artwork in the first place.

Skinny once again shows his true colours with his kneejerk reaction of "take them to the cleaners" before realising it's not actually the same image and that he was talking utter bullshit. There are no grounds for a claim here at all. Making a "similar" image with enough differences (speech bubble, different image of the Queen) is not the same as using an original image without permission. The merch company will have taken legal advice before proceeding and after all the Morrissey image wasn't owned by or licensed by the maker of collage that appeared on TTY - which, lets not forget, many of the usual suspects on here stupidly accused Moz of making... (how wrong they were, yet again).

Is this another in the long line of So_Low's idiotic "Let's take Moz to Court" campaigns which immediately falter as soon as those big brave keyboard warriors come to their senses...?

David, you must be ever so proud. As a long time proponent of M-solo, sorry to see it has come to this.
Meanwhile these 2 never bother with the real trolls of the site and let them ruin threads day in and day out. What a shame.

honestly you wont have much of a case seeing as you most likely don't own the rights to either photo you combined.

They disagreed with that permission so much that they used it on TTY. There is a clear artistic direction here. But, I will get some legal clarity on it.

The originator of the TTY collage did not own or license the Moz image but can claim a "Right to Parody", especially since he's not exploiting the image commercially without permission of the copyright owners of the Moz pic AND the Royal Family pic.

If the "Moz crew"/management/whatever paid for the nude photo shoot in return for copyright of the images, or just bought the copyright of several images from that session, then they are entitled to exploit the images however they like (provided no express limitations were placed on usage when they purchased the image - but you woldn't kow because you haven't seen the contract).

Anything your legal advisor says to the contrary is bullshit, just like everything you've said so far about this is uninformed bullshit too. Get a f***ing life, Skinny.

She'll tell you that collage artists prefer to use copyright-free images to avoid having to pay to licence images that are copyright protected.

Another storm in a f***ing teacup whipped up by Skinny to try to discredit Morrissey. Predictable and pathetic.

Under the guidelines of parody as art, use of the Morrissey image in a collage is negotiable as "fair use." In short, the artist can use a copyrighted image to make a parody for non-profit purposes then turn around and copyright the collage as original artwork.

Poeple here jump on everything, do they? Instead of using their common sense. I can't imagine how many times over the years Morrissey (well, not Morrissey himself, obviously) had to check the 'rights' over pictures, music, music videos, film clips etc. He used/uses a lot of it. Do you think all these rights owners were not paid? And if it happened a few times, so what? With this multitude of rights who need to be checked it happens, but not deliberately by all means. And it actually also works the other way around. I'm pretty sure there are many instances where Morrissey's art is used without permission. That's life. Move on ...

It's pathetic that this fella thinks this piece of dross is worth anything but what's worse is Moz's merch team have picked up the idea and turned It into something equally as shit.
