Morrissey has taken extraordinary action against the owner of a fan website by banning him for life from the singer's concerts.

The former The Smiths frontman declared war on Morrissey-solo.com after owner David Tseng refused to prevent members from discussing the star's private life or criticizing his career moves.

The singer stepped up his campaign against the forum last month by taking to the stage during a show in England wearing a T-shirt printed with the words: "F**k Morrissey-solo.com".

Tseng was shocked when Morrissey's security guards ejected him from a concert in Copenhagen, Denmark on Monday - and now it's emerged the Suedehead hitmaker has banned Tseng from all of his gigs because of his "poisonous" website.

A spokeswoman for the Morrissey tour tells WENN, "Mr Tseng via his poisonous website has caused so much intentional distress to Morrissey and Morrissey's band over the years that Mr Tseng is not welcome at any Morrissey shows."

A UK-based lawyer writes: the lack of understanding as to whether or not a concert constitutes a private or public event amply demonstrates the level of sheer ignorance that pervades this site (for the record, Tseng has no redress or remedy under British, American or even Danish law). Furthermore, if SPM and his band were not public figures, the deliberate, sustained and extensive campaign of public vilification conducted on this website would unequivocally fall foul of the new laws against electronic harrassment (the so-called "internet stalking" laws). If SPM were a commercial brand, there have been numerous instances over the past couple of years where the comments published on this site would constitute criminal libel. Leaving aside the fact that this website advertises itself as a fansite, there are posters here who appear content to perpetuate such a campaign (which, I stress, would result in civil and criminal trials in any other context or circumstance) while naively pleading freedom of speech and attacking SPM's ethics for audaciously daring to retaliate. Frankly, this is an astonishing and indefensible level of hypocrisy.

What if some enterprising soul were to set up "www.murderdavidtseng.com" and posted photos and video footage of Tseng, his home address, family details and daily itinerary, and offered a bounty of $50,000 for his murder? Would that be acceptable because it's simply free speech? No, it wouldn't because it contravenes the law - and free speech absolutely must operate within the boundaries of the law. And before you start claiming that some laws are bigger than others, well that's no argument, I'm afraid: you're either breaking the law or you're not. Advocating the detention and annihilation of Jews would surely constitute freedom of speech under the sub-high school-level definition of the principle which appears to operate on this site; and presumably those Jews who don't board the trains voluntarily and instead speak out against persecution are "fascists" and "enemies of free speech"..?

Whether Tseng decides to close the site or not is irrelevant: the damage has been done and this website is already dead in the water; just a few rabid rats left fighting it out between themselves, and I'm not hanging around to join them.

This site is hosted in the United States and owned by a United States citizen. The US laws and Constitution are different than the laws in the UK. There are some similarities but there are also differences.

Just because someone is a public figure does not mean they lose their rights as victims of libel but they have an added burden:

Under the First Amendment of the United States Constitution, as set forth by the U.S. Supreme Court in the 1964 Case, New York Times v Sullivan, where a public figure attempts to bring an action for defamation, the public figure must prove an additional element: That the statement was made with "actual malice". In translation, that means that the person making the statement knew the statement to be false, or issued the statement with reckless disregard as to its truth. For example, Ariel Sharon sued Time Magazine over allegations of his conduct relating to the massacres at the Sabra and Shatila refugee camps. Although the jury concluded that the Time story included false allegations, they found that Time had not acted with "actual malice" and did not award any damages.

It would take a lawyer to suggest that putting a bounty on someone's head is the same as people offering opinions. Apparently the one thing that is the same between the US and UK is lawyers are usually scum.

This is genius on Morrissey's part.... more comments on the "David T Banned" posts than his shows. Insta-publicity (as evidenced by the number of comments from the Copenhagen show and the subsequent "Banned" notification).

I find it hard to believe that Morrissey takes this seriously... For someone who has built a career and identity out of self-deprecation and humor, it seems implausible that he would actually wade through the countless posts and unlimited drivel and take such offense. I think it's funny that Morrissey fans (or non-fans) actually think that Morrissey and crew are reading through the anonymous (or even non-anonymous) posts anyway... so banning them seems like a silly suggestion.

Morrissey-Solo is no different than Huffington Post. It is an aggregation of news, rumors and gossip in one tidy place. The reason why this site has extreme value is in that it doesn't filter and assumes (possibly incorrectly) that people have the ability to form their own conclusions; the best way to form conclusions is to have a multitude of information at hand.

Do the posters in this forum actually think Morrissey reads through the comments? Do the posters actually think Morrissey would be fine with the site if the Anonymous posters would be removed? Good grief.
 
I learned of this from a Good friend whom I met here In Morrissey Solo ,
(On facebook!)something like 10 maybe 11 or even 12 yrs back.. I have been coming to this website to catch up with you Sirr Morrissey,since 1997! I have been me always have been me. Have had a journal here (with you in mind) Just loviong you music.. Nothing personal. just loving the music and your talent.. I have "met"personally many of your loyal fans. People have even met here and have gotten married! have a family.. have even named their children being inspired by Morrissey solo in some sort of way and of course your music. and YOU!.Some have shown tattoos they have permently put on their bodies to show apprieciation towards your inspiring lyrics.. and how did we all meet? through Morrissey-Solo. Through something that David T has created yes.. But freely including the anonymous. which yes at a certain point I had a serious issue about aswell. But only because of the evolution of computer technology has their been changes. Personally and technology wise.
I hope this is a scam. I truly and really, do hope this is just a silly scam. Heck, Id buy the freaken T you wore! It is promoting Morrissey Solo!. its marking this moment. Id take like an Argetienian!! Pendejo Boludo hijo de Puta, Yet they really mean it in a messing playing around sort of way.. Not My way... Things seem to have changed a bit around here since our day, Mari! With the constant flood of negative, anonymous trolls, there's a lot more garbage to dig through to get to the actual community here. I guess that's partly why we aren't here all the time anymore. I would like to say it's the price of freedom, however, it doesn't make sense that they would ban registered users like Phil and Lynne, yet vile, anonymous posts overrun every article that appears here.
Honestly, I think what has started this latest round of animosity is the negative comments left to Alex from Happy Martyr in regards to Boz and his' video he posted here. Reviews were mixed, but apparently feelings were hurt. Shit stirrers started bringing threads from here to Boz's attention and, at a glance, this place really does just look like a troll haven now, so an assumption was made that people at solo aren't really 'fans' but bitter, no-life having malcontents that just sit around and poo poo everything Morrissey & Co. ever do. So I guess that is the Morrissey Solo user's stereotype in his eyes now. I suppose he knows nothing of you and me, or all the others that used to be up all night in the chat rooms talking about how amazing he is. He knows nothing of the great friendships, relationships, marriages, and births that have evolved from this web community. I doubt if Moz or any of them know of the existence of the forums and chat, where you actually have to be registered to post.
Regardless of how downhill this has all gone, this site has outlived all of the other fan sites because of the freedom it allows. The other sites are boring and contrived and are only updated when new things are going on. I hope you are right about this just being a stunt, Mari. Maybe to drive more traffic to True To You and All You Need Is Morrissey? It's all very sad, to say the least.
