Last night at 7.45 on Via del Corso in Rome, the Police Officer pictured below terrorized Morrissey for 35 minutes demanding "papers". Morrissey had no papers.
The Officer then said "I know who you are." Morrissey replied: "I know the law, I know my rights, and you have no reason to stop me." The Officer shouted very loudly and a crowd of over 100 people gathered. The Officer held his gun throughout the confrontation. After 35 minutes, Morrissey walked away, and the Officer did not follow.
Morrissey says: "This was a deliberate act of terror by this Officer, who had no personal identification, but whose Polizia 113 motor-bike had the plate G2458. I had not broken the law or acted suspiciously. The officer unlocked his gun and held it as he screamed into my face. Some people came to my rescue. This happened outside the Nike store, and many people filmed the obviously insane officer. I believe he recognized me and wanted to frighten me. I did not back down even though I believed he was about to shoot me. I urge people to beware of this dangerously aggressive Officer. He might kill you."

where is his motorbike helmet and his hair is to nice looking to have worn one?

I got so scared when I read the part about a gun being pointed at Morrissey. He needs more security. Europe isn't safe.

The gun wasn't POINTED at anybody. The officer in question just held it.

He actually did break a law, stupid. In most EU countries if a Policeman asks for your documents you must comply. Failure to do so is justification for arrest under Italian law. Fact.

After reading this I am shocked Morrissey was not arrested. Policeman showed a lot of restraint not drawing his weapon. In most countries if you resist arrest, they'll use reasonable force to do so.

A) IN GENERAL


Officers-police officers (state police, carabinieri and other bodies belonging to the army, municipal police - but only if they are qualified as security police officers) may force you to follow them in your offices if you refuse to declare your (Name, surname, place and date of birth) or show an identity document or when there are sufficient clues to believe that the name you gave or your documents is false (Article 11 of 21.3.1978 n. 59): this is called identification or accompaniment.

Officials-police officers who accompany you to the police to identify you must give immediate notice to the Prosecutor of the Republic and may hold you for the time needed for your identification and in any case within 24 hours you must release them. To identify you, you can make signposts (photographs and fingerprints), even without your permission. They can not take hair or saliva without your permission, except in the event that a judge is authorized.

There is no right to appoint a defender.

It is therefore important and - you have the right to claim - that the communication to the Prosecutor of the Republic be carried out immediately at the time of the accompaniment, because only from this moment count the 24 hours within which you must release.

If you refuse to tell your general facts / documents, in addition to the accompanying at the police station that we have spoken, you may be denounced for the following offenses:

- if you are an Italian or a Community citizen, and refuse to say your name, you can be denounced and risking the arrest of up to 1 month (Article 651 BC). Instead, if you do not see the documents you can be denounced and you risk the arrest of up to two months (Art. 294 Rev. Tulps and Art. 221 tulps).

- if you are a non-EU citizen and you do not see the documents (passport-allowed), without a valid reason, to police officers when you ask for it you can be denounced and risking the arrest of up to 6 months; If there is a reason to doubt your identity, you can be escorted to the police for signposts (up to a maximum of 24 hours) - art. 6 d.lgs n. 286/98.

If, however, you provide false information to an official public or a public prosecutor, the offense is punishable by major penalties (which have been aggravated by the so-called security package - dated 23 May 2008, No 92):

Whether it declares (in writing or in writing) false generality and risks imprisonment up to a maximum of six years (Articles 495 and 496 BC);

The same penalty is expected if you alter your body to prevent your identification - eg. Fingerprints (Article 495-ter cp).

The aggravating of clandestine has also been introduced. This means that the punishment for the offense you have committed can only increase because you do not have a residence permit (Article 61 (11) bis).

There is no longer an offense of outrage to a public official, but the offense of insult, ie insult or offense to a person (Article 594 cp), is often used by the authorities and the offense of resistance to a public official (ie when Someone is opposed to violence or threat to an official public or a public servant while doing this an act of office (Article 337 of the CC). You may be accused of the crime of resistance (also) if you use violence or threats against a (Private guards) in service at train, subway and bus stations because they are considered public security auxiliaries.

It is important to know that violence and threat are any kind of behavior capable of opposing the act as it is not a simple passive resistance.(For example, if they block you physically and circles to divinate or defend you in any way you will be accused of endurance). In case of resistance, the punishment is for 6 months and 5 years in prison.

I never carry papers or id on me at any time ever unless im going to buy me some booze--which i also never do, fyi). i need to know for when i begin my new life as an illegal immigrant. hope i wont run into barone!

I think you are required by law to carry ID on you in some European countries like Germany and Italy.

what happens if you're just a "dumb tourist" and you "forgot" your id at "the hotel" because you "didnt know"? also what happens if you dont have any pockets and just want to be carefree and not have to carry a bag?

i dont think ill ever try the "dont you know who i am?" thing on any cops myself. i think only some people can pull that off :p

Not while f***wits like Morrissey are on the lose. Who does he think is? Oh, forgot a Brit, of course, they are the ones who are supposed to be granted special rights by birth... Britain and Ireland don't even belong to the Schengen Agreement, where does he have this idea from that he can walk around Italy without any identification? And why does he assume that anybody and everybody knows who he is. Even I didn't recognize him at first in the street out of the concert context and only in retrospective understood that I had actually met Morrissey, because when I saw him I first thought he was some grumpy old man with bad grey hair whom one better gets away from as quickly as possible. If the police officer said "I know you", this can mean anything. Maybe he saw him somewhere else before and nobody except the two of them know what Morrissey was doing then. Or he mistook him for somebody else but this was the whole point in asking for his identification papers, which he didn't show. To claim that they should go after terrorists and not artists like him who are completly full of themselves is just as laughable. He should have just shown his ID and everything would have been fine. I was once stopped by federal police on my way back from the Netherlands and I had to show my ID and my car holder certificate, the best looking man I ever met checked the number plates and that was it, I could proceed with my journey knowing that if somebody had stolen my car that person would not have gotten far, at least not further than this check. That all those unidentified people from anywhere and everywhere are currently walking around continental EU claiming to be whatever they want, doesn't mean that they are doing so legally and that they or anybody else has any right to do so! Morrissey included, whose identity at this point was not verified as he didn't show his identification papers. Is this really so difficult to understand? And yes, these police officers do have more important things to do than be held up by morons like Morrissey who think they are clever when they don't carry their ID with them and play smartarse when they are asked to show it. If he had had his ID with him, he could have walked on within two minutes. My goodness, what an attention whore. As for the people who are writing about this in the media, they could at least add the correct legal information that surrounds this case so that morons like Morrissey know better in the future. I bet the Italians can do perfectly without Morrissey because as far as I remember he was very quick to cancel concerts there before and when he did show up he wasn't particularly enthusiastic. He probably had some problem with his restaurant owner, but even having sex with an Italian doesn't give him any right to walk around Italy without ID... or hazzel police officers who are doing their job.
