punk_lawyer writes:

I recently had a client who asked me, as his lawyer, to draft his Last Will and Testament with the following language in it:

"   ITEM V: However, should my said wife predecease me, or die within sixty (60) days of my death and if I have no living children at the time of my death, then I give, devise and bequeath all of the rest, residue and remainder of my estate to [name deleted], IN TRUST, to be held for the benefit of two musicians commonly known to the him as Johnny Marr and Morrissey. I direct the trustee to send a certified letter to each of the two musicians, or otherwise make personal contact with them or their representatives, stating that if they meet with one another alone in the same room for more than one hour they can be given all of the property held within the trust. Should they refuse, the trustee is directed to set up a scholarship fund in the name of the two musicians and administer the scholarship fund in a manner that is prudent to him."

I found it rather amusing that this guy had a dying wish for Morrissey and Marr to get together. Also, judging from this guy's potential estate, Morrissey and Marr could divide a couple of million dollars just for getting together for an hour. I told him that their separation was more a matter of principle than a matter of money but he still wanted to put them in his will in some way.

How can they resist a man's dying wish that they get together?

That is, unless you've gotten their consent. So I'm forced to conclude (a) you're not a lawyer; (b) you're an unethical one; or (c) your client actually gave consent. Hopefully, it's the latter.

  • As an attorney, a Morrissey fanatic, and someone who checks this site about once a week, I can honestly say that this is the most intriguing post I have read in a long time, if not the most beguiling post, ever.

    This...Charming Clandestine Affair!

I am seriously in awe, and speechless, which as you know for us, is rare.

I want to make a joke...but...while I find this funny, I also find it deadly serious...that someone would go to such lengths to put the Smiths back together...and for such a potentially large sum of money.

p.s. I know that you did not violate any rules of Professional Responsibility as you redacted the name(s) and obtained client consent.

  • I was just reviewing some of my old issues of music magazines with interviews with Moz, and it seems as of even 1992, Moz and Marr are good friends again, but just at that point felt creative collaboration was behind them. This guy's money is better spent on truly struggling people. Have him bequest that money to Rancho Los Amigos Hospital in Downey. This historic rehabilitation hospital (only three of its kind in the nation) was nearly shut down by the County of LA's (therefore state, therefore national) budget problems this year. In fact, if Morrissey wants to help the community of his LA fans, he should donate as well. If I was in their place, I sure would.

  • Isn't it against the law to be seeing this person's last wishes and commenting on them? I think it's a little bit unethical.

Anyways, maybe Morrissey and Marr will decide that a scholarship fund is more "charitable," so they won't actually have to meet face to face. Besides, I don't think meeting face to face is their problem. The will should have said, "This money will be theirs if they arrange a SMITHS REUNION TOUR!"
Then we'd all be thanking this person on bended knee. Maybe greed would do the trick.

Most people underestimate the potential that the Smiths had if they had stayed together longer.

This man obviously does not and I commend his brilliance. It also shows how deeply THE SMITHS (read: not Morrissey by himself) touched people.

He told me that when Johnny performed at Linda McCartney's tribute show a few years ago he was actually in discussions with Morrissey for both of them to perform 'Meat Is Murder' together at the show. However, they both felt that maybe their reunion would overshadow the fact that it was a Linda McCartney tribute show. So Johnny performed it on his own.
