An anonymous person writes:

A $50M lawsuit will be filed in Los Angeles superior court against KROQ on Monday. The petition will claim KROQ defrauded fans by delaying the Morrissey announcement by 7 hours and profiting on over $14M in beer/food sales during that time period.   • Who is issuing the lawsuit? Why is the suit for $50M while the claim is KROQ that made $14M from delaying the announcement. How will the fans who were allegedly defrauded be recompensed? I don't know what slam dunk means but it doesn't sound serious. It sounds more like a party game. More details please?

    But seriously, isn't this news as incendiary as the "Morrissey didn't pay his crew" news from ages ago. Moz's people will be crying foul soon - Jed Weizman will be saying cease and desist faster than Beligerant Ghoul can e-mail a Moz story to David.

    Also, a mate of mine from Madrid went to Benicassim, which was also cancelled. What's become of that? Why isn't there a lawsuit there?

    Are Americans sue happy opportunist? Or is this about more than money?

    Oh also, I never went through with my plan of checking up on Alain -- for anyone who is curious. dunno... seems like a waste of a Saturday.

I don't believe there is any kind of lawsuit planned and I also don't think we should expect that the free concert will actually take place...

  • the lawsuit does make a bit of sense though... the announcement was made in the middle of the day, and only once. of every time a kroq dj introduced another band (devo, franz ferdinand, etc etc), i kept expecting them to remind people that morrissey would not be playing, but they didn't.

    there was one staff member down by the entrance for the orchestra (at least that i saw) holding a flyer saying that morrissey was ill and had canceled, but 5 minutes later, her sign was gone.

    i kept expecting to see the flyers posted all around the venue, by the merch booth (who continued to sell morrissey merchandise), by the conscession stands... nothing.

    I think the figures are inflated and I doubt that this is a winner of a case...they did notify the fans (timing is another matter) and if they honestly try to schedule a make-up concert or refund the tix then they've lived up to their deal. Sorry, but if they got word once people were in the pavillion, it's pretty difficult to give refunds at that point.

    Still, this is probably the end of the line for KROQ+Moz

Suddenly he's responsible for the death of Lollapalooza, and now a $50M lawsuit against KROQ. There's only one reason for this...

  • While I admit that lawyers are the most creative people on earth when it comes to things about which to file lawsuits, I have to say that this one is difficult if not impossible.

    First, there would have to be a certification of all of the fans as a class. This would allow a class action to move forward against KROQ. However, each member of the class would have to show representative damages. How many people travelled to the show from out of town? How much did they spend to travel? How do you organize the class? Most of the time these things take forever to even get started.

    Second, KROQ did put on a show and a decent one. There was some value in seeing the remaining acts - just how much of the ticket's price was attached to seeing Morrissey? If there is a make-up show with Morrissey are there any damages suffered at all?

    Do major league baseball teams have to refund money when the previously announced starting pitcher is too sick to pitch? Of course not...you still watch the game but maybe it wasn't as good as you wanted it to be.

    If I were KROQ's lawyer, I would be saying "Bring it On..."

  • You didn't miss a thing...the fact that 50k+ people trekked all the way to Devore CA., to end up seeing Billy Idol ended up stealing the show is a farce. I feel very cheated out of my hard earned money.
    -Ian Brown sucked....
    -the sound on the second stage was blown...
    -Beers were $10
    -Water was $5
    -KROQ waited till almost 3PM to announce that Moz was not performing....

      KROQ running a scam!? absolutely....

    Someone at KROQ must have known before the day started....I think they got freaked out because half the people attending were there to see Moz..no question about it...if everyone was allowed to get a refund before the show started, it would have been a disaster for them. Fucking ass holes! I hope they get their ass handed to them in court!!!!!!!

    FINALLY, how feasible is it to get THAT venue for something such as this??? My buddy FLEW from AZ, then rented a car & we drove from SAN DIEGO!!! I want a ticket to see him HERE in SD, where we'll actually SEE him (NO BINOCULARS ALLOWED @ THE BIGGEST VENUE IN THE FRIGGIN' COUNTRY... that seems fair, when all the "athletic supporters" don't miss a precious moment of "the big game!"

  • In addition to this whole Morrissey fiasco, why was Kroq billing Siouxsie et al. as "Siouxsie and the Banshees"? The only "Banshee" there was Budgie, and her current tour is titled "An Evening With Siouxsie," with no misleading mention of "Banshees." It was really more of a Creatures set as she's on tour promoting the latest Creatures album. Some people at the Inland Invasion seemed to be surprised at the songs Siouxsie was playing. I think Kroq also misled ticket buyers into thinking that Siouxsie's set would be some kind of 1980s Banshees nostalgia in order to sell more tickets.

    This whole festival can only be association with greed, and I'm glad I decided not to attend in the first place.

  • i think the makeup show is probably an even better deal. if i were a fan and lived in the area, i'd be thrilled with that news.

    why? because this weekend, i went to a completely different music festival. I was trying to see Modest Mouse, but i was denied an even halfway decent experience because:

    1. people were already staking out claims to the Pixies later on that night.
    2. since that audience was full of people who wanted to say that they saw the Pixies, i had to endure people talking through the set and such snippets of dialogue as "I don't know...i think they're called Mighty Mouse...."

    yeah, you people will definitely appreciate the experience without Tears for Fears fans who don't feel like moving their lawn chairs.

  • First off, let me say that if KROQ did find out from Moz's crew that he wasn't going to make it, then they should have announced it throughout the day and informed fans coming in. Hell, fans should have known about it if they were hearing KROQ. At least have a sign, do something. I mean, keep it up throughout the whole day. Don't just leave it up for five minutes and take it off. Don't just announce it once on air. KROQ kept quiet and made a profit. They probably deserve to be sued.

    As for the 14 million dollar profit in food/beer sales: I am no mathematician, but that sounds just about right. Actually, it doesn't sound like enough. We are the country of KING SIZE, and BIGGIE UPGRADE, so it's possible. So all you Euros who are coming here and calling us fat, you're right. We are. BIG cars, BIG meals, that's us. We can afford it. Except for the state of California. I wouldn't be surprised if parking made up about 6 million more. The Hyundai Pavillion is a horrible venue.

    One more thing: Those of you who are comparing this to a baseball game or other sporting event are way off. You don't go to a game just to see the starting pitcher, unless it's Nolan Ryan getting some more licks into Robin Ventura. You go there to see the game. You go to a Laker game to see the game, even if Kobe is hurt. Other factors play in, such as a team's rankings or playoff runs. A concert, is a totally different thing. While many of us have seen Moz more than once this year, where is he the rest of the time? Concerts are much more rare and hold higher value than a single game during a season because they are only dependant (in most cases) on a recent album. When most acts come to your town, you are asked out if you don't see them. I can imagine there were many people who went there solely for Morrissey. Some may have gone for the first time. It should not be held against them because Moz chooses to do 6 or 7 shows in the area at the start of the tour with plans on doing 6 or 7 more towards the end. People should have been notified by KROQ, and given the chance for a refund. It doesn't matter that there were other bands, Morrissey was the main attraction, and the prices they were charging for tickets, parking, food, and BREWS was too much for what they were offering after Moz cancelled. Don't get me wrong, it must have been a great show with all those bands put together, but not for the prices they were charging. If KROQ loses, they deserve it. Either way, it would be in their best interest to make that make-up show happen. Or else fans may not be so willing to attend their future concerts, Morrissey or not.

        I agree with you on most of your points. Good ones by the way. It's a fact that KROQ is hiding behind a strong shield. There were other major acts that did show up. Granted, every concert is expensive. But KROQ would not have made nearly as much money as they did, had the news of Morrissey's cancellation been known earlier in the day. Or for that matter, his involvement with the promotion at all. The supporting acts they had just weren't enough to earn them 14 Mil in food/beer sales alone. Whether i'm right about this or not, the plaintiff will have a very hard time proving this in a court of law. KROQ's intent to hide the facts will be even tougher to prove. I agree with you on that. Again, I am no lawyer, but something has to be said for the fact that the main headliner was a no-show, and KROQ knew about this before noon the same day.

        I am a sports enthusiast however, and there is no way that you can place a ball game in the context of a concert. That's just impossible. There are 162 games a year for every team, nearly half of which are played at the same spot. Nevermind the unpredictability of injuries and slumps in baseball, for over a hundred years fans have known to expect that. When a potential record comes about, you don't see "Mark McGwire VS. The Pittsburgh Pirates". It's still "St. Louis VS. Pittsburgh". That never changes. Of course those fans aren't getting a refund. It's baseball. I'm not saying that rock stars can't get injured like ball players. But these guys go out 162 times a year. I don't care how long a tour lasts, you just can't compare it. No way.

Most likely, they'll settle out of court, as in most cases, but what is more interesting is to see what will happen to Morrissey in this case. Depending on the contract, and I'm sure Mozzer protects himself, this could have some legal consequences for him. However, I really doubt it. Poor, poor KROQ.

They don't let you wear spikes or chains, can't bring in lighters, made me throw away the backing to one of my Siouxsie buttons because of the needle, and you can't wear wallet chains. Now I can understand how some idiots think that this offers more protection which is fine...but what the f@#k do you find when you go inside? THEY SELL ALL OF THAT SHIT...huge buttons, wallets with chains, tons of spiked jewelry, lighters...and even f@#king pipes and bongs! What the f@#k is up with this place?!?!?! I was livid...LIVID! And then they try to rape you in other ways like charging $5 dollars for a cup of water...and they won't give you the plastic bottle so you can close it up and make it last throughout the day...they poor it in a huge f@#king cup so you have drink it all in one sitting or be stuck carrying around this shit that's gonna spill if you try to dance around to one of the bands. And then....none of the f@#king food places have napkins...and why u ask...one lady told me that is was because people might set them on fire. WHAT THE HELL ARE THEY TALKING ABOUT!!! There's sh!t paper in the bathrooms and paper towels as well...and not to mention a ton of other crap that can be burned all over the place. Whoever came up with these idiotic rules and restrictions are f@#king Class A Idiots. Unf@#kingbelievable that there are people that think like this in the world.

  • I left for the concert mostly to see Morrissey at 11:30. I listened to KROQ on my long 2 hour drive, not once did they mention anything and now that I know that Morrissey was pronounced ill at 11:00 I am extremely angry. I don't think anybody would have paid $50 for that line up without Morrissey. I didn't even hear about it from an announcement but from a drunken, angry fan who was about to start a brawl at about 5:00pm. And Billy Idol, I am not feeling alright, I am pissed off!!!

  • There were rumors on Saturday about Morrissey not appearing at the concert, I called the radio station somewhere between twelve thirty and one p.m. I asked if it was true that Morrissey was cancelling and the person who answered the phone said " As far as I know he is still playing," and we all know that by that time the station already knew that he was ill and that he wasn't going to show up.
      I think that it is wrong for the people at the radio station to try and trick us into going to the show and not telling us about Morrissy's cancellation. After all if there is going to be a free concert given by the man himslef then what's the point of hiding it right?

  • I was at the concert Saturday. It was clearly announced after Ian Brown & The Stone Roses played Morrissey representative came out and let everyone know that Morrissey was unable to make it, because he was at home with 103 degrees fever.
    Not to Mention that Ian Brown was mentioning it on stage, but People were booing him in disbelief.

What should have been a wonderful triumphant weekend playing to 35,000 of you in LA and 10,000 or you in San Francisco ended on Saturday morning with sinusitis, acute laryngitis and a high fever with orders from Dr Joseph Sugarman to get to bed and not speak for the next 48 hours at a minimum. Sadly we not only had to postpone the shows but also cancel (at great expense!) the video shoot for Let Me Kiss You which was due for Tuesday. The most important thing of course is Morrissey’s health and we are happy to report that with the prescribed rest he will be ready to go next week and we will make an announcement later this week on a special event to make up for the KROQ show that all 35,000 of you who were there on Saturday will get to see and the same for the ALICE show in San Francisco. On a final note we understand that there are those in the Morrissey community on morrissey-solo.com spreading erroneous rumours about lawsuits and questioning whether KROQ did everything possible to bring you the information in a timely fashion. I can assure you that the rumours are false and the integrity of KROQ cannot be questioned. They handled a very difficult situation impeccably and you should treat anything you are told to the contrary as rubbish.

First of all nothing near that number was made on any concessions nor did that money go to KROQ you fucking idiots. How do you think that venue makes money? Do you think KROQ makes all the money on the ticket sales and the merch and the food and drink. It is almost funny to think that there are people who think KROQ had some control of that situation. Unless you work in the music industry don't assume to know it's inner workings.
