Name this Smiths sampling tune

There is a fairly popular song (in the U.S. at least) that used a sample of the guitar swell from the beginning of 'Unhappy Birthday' all throughout it.

It was not credited to Johnny Marr in any way and I don't think he was ever paid for the use.

He may not even be aware that it was done.

Is anyone else familiar with this song?

How would I give him this information?

Are you absolutely sure it's a sample? It's really not that difficult to create that sound.

That's a good point, mcrickson. I did A/B the two and they are absolutely identical in every way including length, key, and tone.

This song is by a band that was in the "alternative" genre in the mid 90's whose members were fans of the Smiths.

This song charted very high on the rock charts and sold a lot of copies so there is definitely money owed to Marr.

I am curious to see if anyone else remembers this song without me saying the artist or title.

Actually, in Marr's case it is legally considered homage so he owes nothing to no one. I am talking about a direct sample that was uncredited and unauthorized and the band got away with it. I simply find it interesting that no one around such a knowledgeable place like this seems to have noticed. And I mean that sincerely.

I too remember hearing a song sometime in the 90's and everytime it came on I swore that it had the Unhappy Birthday sound in it, but I think it might have been pre-internet, or at least pre-me-having-good-access-to-the-internet, so there was no option of hearing it on the car radio and then coming home and googling it, like I would today.
