Andy Rourke to sue Morrissey? (rumor)

The Manchester Moz writes:

While getting a Morrissey style quiff at a hairdressers off Manchester's Oldham Street I got into a conversation about the Morrissey gig at the Royal Albert Hall, The barber said "he was in London but missed it", I said that Morrissey might play Manchester later in the year but he told me how "there are to many people who dont like him up here, too many lawyers", He then said "my friend issued him a writ the other day before his RAH gig", I asked him who his friend was and he said "Andy Rourke".

I asked him what he was suing Moz for and he said the usual, unpaid royalites etc and we got into a discussion about the whole courtcase and stuff like that.

Anyway I work in a nightclub called South in Manchester and Andy Rourke visits quite a lot (he's even DJ'd there, Clint Boon is the resident DJ though), so i'll try and ask him about it next time I see him. Personally and the barber agreed with me, he's just trying to cash in on what Mike Joyce got. He told me how "Andy was in a very bad way at the time of the courtcase and had to accept the £20,000 pay off".

I guess we'll just have to wait and see. From experience though at work Andy Rourke can be a bit of a chancer and will try to get things for free coz of his name, which doesnt please my manager!

this will be going on until they're all 80 years old, and i think by that point, morrissey and marr will be praying for alzheimers just so they won't be able to know what the hell a writ is. All of this over 4 years of work. If the settlement wasn't good enough then, he should have found a real job and held out. But he took the money, and so i hope the judge tells him "tough noogies".

I hope that they will all be happy with the 2 quid they all get apiece after the lawyers get it all.

I know this is a rumor, so I'll try not to go off. But this is ridiculous, here we are about 15 years later, and this isn't over with?

I think it was pretty low of Andy to serve Morrissey right before his gig. That's just low!

What type of Writ was issued? A writ to attach Morrissey's property? Bank Accounts? Accounts Receivable? If this rumor is true, Morrissey had to have known about it prior and seen it coming. You can't just go around obtaining Writs to levy on someone's personal property, it's a long process, and Andy would have had to have obtained a judgment against Morrissey. At least you would here in the states. How different is the process in the UK?

      Poor Moz, this sucks.

When I finish law school Morrissey, I'll be your lawyer.

Considering you must actually pay your lawyer in the UK regardless of the outcome, Rourke would have to pony up some serious cash to make this rumour happen. (Unlike the US, where litigation is a court version of the lottery...) And in any case, he wouldn't win, as he explicity accepted a cash settlement years ago. Plus, after a judge notices that the Rourke-penned "The Girl Least Likely To" isn't really a song as such, Rourke won't have a leg to stand on.

This is gossip, not news, and very irresponsible of you to share like this. Next time just go direct to pop bitch. Andy Rourke hasn't made any statements, you're like a slack-jawed schoolgirl who cant wait to scribble rumours on the back of the bus seats. This is your interpretation of hearsay, it's not being made public and whether is/isn't true it's none of your/our business and hardly news for this website.

If every Morrissey rumour was put on here - the supposed names of his boyfriends etc - then it would harm credibility of this site. It's just anti Rourke propaganda, and none of us know full facts (and if he WAS served a writ at Albert Hall then it may be because he doesnt have LA address and knew he was going to be in London then - but besides Rourke's been touring Europe with Badly Drawn Boy so how could he have?).

Sorrow will come to everybody involved in the end.

Anyway if he did want to sue me he wouldnt have much luck I have about £8000 debts to my name and nothing else, Anyway Andy if you read this and if this is untrue i apologise deeply but im only reporting what I heard dont take it personally.

After all he was fucked around by Moz and Marr and us fans will never know 100% what went on so its unfair to comment with personal opinion like I did but hey if I didnt report this we'd never know. I guess we'll just have to see if its true

I dunno if any of you on here are from Manchester but if you work in the indie trade or up Oldham Street you'll see everyone knows everyone. And to be fair this guy is Andy's friend and was actually saying he was treated shitly but believes its all in the past now and they should all move on.

On the subject of Damon Gough (Badly Drawn Boy) he is an absolutely top bloke and he used to DJ in the club as well. Congrats to him on the birth of his 2nd child recently.

No. So leave it out alright? I have met Andy Rourke and found him to be one of the most polite, sweet guys ever. Can't say the same about Mr. Morrissey. Don't get me wrong, I'm a huge fan and love the guys music to pieces, but we all know he's a bit of an egomaniac. So lay off Rourke, he's a talented bass player, and if you are really any kind of music lover, you will recognize the fact that Andy Rourke was an essential part of the SMiths, and it was not just "Morrissey's old band".
