well, I guess the company that asked for my permission to use a photo I made of Morrissey covering the queens mouth is on a t shirt. Sean Preston with Merchandising for life (Mporium) emailed me right after I made that photo which was put on the cover of truetoyou.net asking if they could make it into a tshirt. He asked for the high resolution file and asked how much I wanted for it. I told him that I spent a long time on it and that I had put my heart and soul into that photo, just like I do my other work and that I would be willing to let them use it, but to give me an offer. I wasn't thinking anything ridiculous, but he never got back to me. Instead I see they took my idea, almost exactly except for the background, and put it on a shirt. I don't know what to make out of this. Part of me is happy that its out there this way, but another part is angry that they reach out to me in the beginning for my idea.. I respond, and then they steal it. What do you guys think? Here are the photos, one of the photo I made, and the other of the shirt being sold at the concert in Nottingham.. Any feedback in appreciated. This is their website and I am attaching the photo I made and the shirt they made...

I agree that it sucks but they will just come back with the fact that the photographer (who shot the photo of M) was paid at the time of the photoshoot (one would hope) and they could use the photo as they wish.

Yep. It's not the OP's photo so there's nothing he can do.

They disagreed with that permission so much that they used it on TTY. There is a clear artistic direction here. But, I will get some legal clarity on it.

Sorry to say, but unless you own either/both images used to cobble together this fun photoshop project, there is not much that can be done. Should have given them a value on your time from the get go or even asked for life long passes to gigs.
My legal advise is to email the person who contacted you and let them know what you want., Unless this shirt sells like the new World of Warcraft (which it won't), don't bother trying to find a lawyer who will handle this case as it is evident you actually do not own the right of the images M used for his shirt.

It's very impolite to open negotiations, and then do it anyway, but on the other hand - do you own the copyright of the naked Morrissey photo? Do you own the copyright of the royal family photo?
No - you just nicked them.
I know you weren't trying to make money off the initial image, but you are in very dodgy artistic ownership territory here, so I can see arguments either way.

Perhaps, but it shows that Morrissey's design team doesn't respect the intellectual property and by extension the integrity of the original artist. The guy sounds like a douche looking for a buck, that hatch job probably took less than five minutes to paste together, but the people PROFITING from the spirit of the image should follow the unspoken rule of dumdums who don't slap a copyright on an image to NOT rip it off. At the end of the day it makes Team Morrissey look like a bunch of money-grubbing scumbags.

Using a picture of Morrissey that he commissioned, and applying the image to another photo (a different photo) than what was used is hardly grounds for legal action.
If someone used the M's lyrics/vocal track of "Trouble Loves Me" and layered it over a calypso beat (yes, we are all waiting for THAT to happen) and then M decides to put out a record of "Trouble Loves Me" over a calypso beat, the person who thought about the idea and even put out a version (without consent), stand no ground.
I know you came on here and shared your story, which is admirable, but please don't bother listening to those who are quick to press charges a the drop of a dime. They have an odd pent up anger that only their psychiatrists and mums might be able to explain.

If the person who mocked up the original Royal family w/Moz photo created it without Morrissey's permission then it's not their work to begin with. Morrissey owns the "I'm Throwing My Arms Around Paris" artwork and he can do what he likes with it. The Queen may have a gripe but I doubt she'll bother. Or were you offering your services to the Queen?

Also, he has a case. The fact that they contacted him asking to use the image shows they KNEW they needed permission to use it. To then turn around and make a second version with the queen wearing a different dress doesn't change the fact they were aware of the original artist's name/contact info/etc...

It's a mess, and for what? The queen wins AGAIN.

Original artist, are you kidding or what? Some dude grabs a pic of the Royal family and a pic of Moz and photoshops them together and that's art that they supposedly own? Come off it CG. The original (cough, splutter) artist does not have a photoshopped leg to stand on. Just because you make a collage and post it on the net, it doesn't make it copyrighted. If he was so precious about it he never would've posted it in the first place.

I will be buying one of these shirts for sure :)

£25 selling price, so that's what - £22 profit per shirt sold? I wonder how much they will make altogether.
Look on the bright side. Thanks to you, Morrissey's 5 star hotel bill will be paid for a couple of nights on this tour. :)
