new york based jewelry house fenton's fall 2005 collection is inspired by lyrics of morrissey and the smiths. the jewelry collection is carried at stores like barneys in new york, seattle, and los angeles, and ikram in chicago. sterling silver cuffs and bangles, for men and women, are etched with various lyrics ("scratch my name on your arm with a fountain pen," "i'd rather be famous than righteous or holy," "love is natural and real but not for such as you and i," and so on...). style.com will feature an article on the designer and her inspirations, as well as upcoming issues of elle, british glamour, and british vogue. look for fenton in harvey nichols london, as well as hong kong!!!

Do you think Moz will receive any compensation for the use of his lyrics? Intellectual property and all that stuff, I mean... Anyone in law know anything about this and care to chime in? Seeing as they're taking words from copyrighted songs, they can't just say, "Oh, we just put phrases together" or something since quite a few people will recognize from whence they came...

A song like "Oh Susanna" or "She'll Be Comin' Round The Mountain" is public domain- they're listed as "traditional" and don't require licensing or royalty payments as far as I know...

Now, a song like "Happy Birthday," which everyone sings at one time or another, is a published song -meaning if it's recorded and released commercially- royalties must be paid. Performance, may be similar; ever notice on some television shows (sitcoms or dramas) when there's a birthday involved, they sometimes don't sing "Happy Birthday" but sing a made-up variation? They didn't want to pay the royalty so they made up a song! The point is, you don't have to pay if you're singing it at a birthday party, but if the party was televised, performance royalties are due. The same goes for radio or television- everytime you hear a song or see a music video, it's marked down and royalties are paid.

Think about those of you in school musicals or some sort of drama production. Ask your teacher or drama coach about having to "buy" the rights to produce a musical, "Jesus Christ Superstar" for example... That's paying a royalty.

but a jewelry chain in SO CAL used "There Is A Light..." in it's commercials last year. they played the crap out of it for a few months and i never saw it again.

i'm guessing the company was sued or went out of business

as a representative for fenton (Score:1)

we would like to clarify that the inspiration coming from morrissey was from rusholme ruffians "scratch your name..." and the fans that tattoo themselves with morrissey's lyrics. from that, we are scrimshawing or tattooing IMAGES into bone pendants. we are not using morrissey's lyrics on bracelets for sale. we produced a few for friends who have supported us but they were gifts and are not for sale. we don't have any idea where this information is coming from...we ARE carried at Barneys, not at Harvey Nichols. we would love for you to check out our collection but realize that the collection is inspired also by victorian mourning and oscar wilde. morrissey's connection is solely through tattooed ink and his obsession with oscar wilde. WE ARE NOT USING HIS LYRICS FOR PROFIT. however, we would like to use this opportunity to thank morrissey and the smiths for putting out music that matters and for giving us endless hours of happiness while we work on our collections.

Lawsuit? (Score:1)

Well, I am late in this discussion, but I think that if Morrissey can sue this company, he could be sued as well. After all, he took a lot of his lines from films, books and other people's songs.
